The Health Effects of Felonizing Fentanyl Possession

Project Summary

The primary goal of this project, as outlined by the legislation (House Bill 22-1326), is to study the health impacts of felonizing fentanyl possession. Specifically, we aim to assess changes in fentanyl-related overdose rates, both fatal and nonfatal, among individuals charged with drug-related crimes compared to those without drug-related crimes, and to individuals with opiate misuse or use disorder not charged with drug-related crimes. Additionally, we will evaluate the initiation and retention rates of evidence-based treatments for opiate use disorder across these groups.

Secondary objectives include examining the differential effects of criminal penalties on marginalized populations and ensuring that future policy changes incorporate the perspectives of those with lived experience.
